Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Dibbbs platform — including the mobile application, website, and all related services — operated by Brewit Studio ("we", "us", "our"). By creating an account or using any part of Dibbbs, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the platform.
1. Definitions

2. Eligibility
You must be at least 18 years old and a resident of India to use Dibbbs. By registering, you represent and warrant that:
- You are at least 18 years old
- You have the legal capacity to enter into a binding agreement
- The information you provide during registration is accurate and complete
- You will keep your account information updated
Dibbbs is not intended for children under 13. If we become aware that a child under 13 has created an account, we will terminate it and delete the associated data.
3. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:
- Use a strong, unique password and not share it with anyone
- Notify us immediately at contact@dibbbs.app if you suspect unauthorised access
- Not create accounts for others or maintain more than one active account
- Not transfer your account or access to another person
We are not liable for any loss or damage arising from your failure to keep your account secure.
4. The Dibbbs platform
Dibbbs is a marketplace that connects home cooks with customers seeking home-cooked food. We facilitate discovery, pre-ordering, and payment — but we are not a restaurant, caterer, or food manufacturer.
Chefs are independent sellers and not employees, agents, or partners of Dibbbs. We do not prepare, package, or deliver food. Dibbbs is not responsible for the quality, safety, or content of food prepared by Chefs, except to the extent expressly stated in these Terms.
5. Customer terms
5.1 Ordering
Dibbbs operates on a pre-order model. When you place an order, you are making a binding commitment to purchase the items selected. Orders are confirmed when you receive an order confirmation notification. By confirming an order, you represent that all information provided (including delivery address and contact details) is accurate.
5.2 Payment
Payments are processed by Razorpay and/or Cashfree, both RBI-regulated and PCI-DSS compliant payment gateways. By placing an order, you authorise us to charge the full order amount (including any applicable taxes or delivery fees) to your selected payment method.
Dibbbs does not store your card number, CVV, UPI PIN, or any other payment credentials. All payment data is handled exclusively by our payment gateway partners.
5.3 Delivery
Delivery is fulfilled by the Chef or a third-party delivery partner. Estimated delivery times are provided in good faith but are not guaranteed. You are responsible for ensuring someone is available to receive your order at the delivery address at the scheduled time. Dibbbs is not liable for delays caused by incorrect addresses, inaccessible locations, or events outside our reasonable control.
5.4 Cancellations and refunds
Because Chefs begin preparing food in advance, cancellations must be made before the Chef's preparation window opens for your order date. The exact cancellation deadline is shown at the time of ordering.
Refunds are issued in the following circumstances:
- The Chef cancels your order
- Your order is not delivered through no fault of your own
- The food delivered is significantly different from what was described
- You cancel within the permitted cancellation window
Refunds are processed to your original payment method within 5–7 business days, depending on your bank. To raise a refund request, contact us at contact@dibbbs.app within 24 hours of the issue.
5.5 Food safety
Home-cooked food is prepared in domestic kitchens. If you have any food allergies, dietary restrictions, or intolerances, you are responsible for confirming with the Chef (via in-app messaging) before placing your order. Dibbbs cannot guarantee that any item is free from allergens. Consuming home-cooked food is at your own risk in respect of allergen exposure.
6. Chef / Home Cook terms
6.1 Registration and compliance
By registering as a Chef on Dibbbs, you represent and warrant that:
- You have read and understood all applicable food safety laws, including the Food Safety and Standards Act, 2006 (FSSAI Act) and rules thereunder
- You hold, or will obtain, any registrations or licences required under FSSAI regulations for your scale and type of food business
- The food you prepare and sell complies with FSSAI standards for safety, hygiene, and labelling
- Your kitchen meets applicable hygiene and sanitation standards
- You will comply with all applicable local, state, and national laws governing the sale of food
Dibbbs may request documentation of your FSSAI registration at any time. Failure to provide adequate documentation or to comply with applicable regulations may result in suspension or termination of your Chef account.
6.2 Menu listings
You are responsible for ensuring that your menu listings are:
- Accurate — descriptions, photos, ingredients, and portion sizes must honestly represent the food you will prepare
- Complete — you must disclose major allergens (nuts, dairy, gluten, shellfish, etc.) present in each item
- Lawful — all items must be legal to prepare and sell under Indian law
We reserve the right to remove listings that violate these requirements or that receive sustained complaints about accuracy or food safety.
6.3 Fulfillment
When you accept a pre-order, you commit to preparing and delivering (or making available for pickup, if applicable) the order on the agreed date. You must notify Dibbbs and affected customers promptly if you are unable to fulfill an accepted order. Repeated cancellations or poor fulfillment rates may result in suspension or removal from the platform.
6.4 Pricing
You set your own prices. Prices must be listed in Indian Rupees (INR) and must include any applicable taxes (GST). You may not charge customers separately for amounts not listed on the Platform. Dibbbs charges a platform fee, which is deducted from your earnings before payout. The current fee schedule is available in the Chef app.
6.5 Payouts
Earnings are paid to your registered bank account after deduction of the platform fee. Payouts are processed on the schedule shown in the Chef app (typically weekly). You are responsible for declaring your income and paying applicable taxes. Dibbbs may withhold payouts if there are active disputes, suspected fraud, or outstanding compliance issues.
6.6 Independent status
Chefs are independent sellers and not employees, agents, contractors, or partners of Dibbbs. Nothing in these Terms creates any employment, agency, partnership, or joint venture relationship between Dibbbs and any Chef.
7. Prohibited conduct
You must not, and must not enable or encourage others to:
- Provide false or misleading information in your profile, listings, or reviews
- Use the Platform for any purpose that is unlawful under Indian or applicable international law
- Sell, list, or deliver food that is adulterated, unsafe, or prohibited under the FSSAI Act or any other applicable law
- Engage in price manipulation, fake orders, or review fraud
- Harass, threaten, or abuse other users, Chefs, or Dibbbs staff
- Reverse engineer, scrape, or extract data from the Platform without our written consent
- Attempt to gain unauthorised access to other accounts or our systems
- Use the Platform to advertise, promote, or sell services outside of Dibbbs
- Circumvent the Platform to transact with other users off-platform (e.g., collecting direct payment to avoid platform fees)
- Upload malicious code, spam, or any content that disrupts the Platform
- Impersonate any person or entity
Violation of these rules may result in immediate suspension or permanent removal from the Platform, without prejudice to any legal remedies available to us.
8. User-generated content
You may upload content to Dibbbs — including profile photos, food photos, menu descriptions, and reviews ("User Content"). You retain ownership of your User Content, but you grant Dibbbs a non-exclusive, worldwide, royalty-free licence to use, store, display, and reproduce it for the purpose of operating and promoting the Platform.
You represent and warrant that your User Content:
- Is accurate and not misleading
- Does not infringe the intellectual property rights of any third party
- Does not contain hate speech, harassment, nudity, or violent content
- Complies with all applicable laws
We reserve the right to remove any User Content that violates these Terms or that we consider harmful to the Platform or its users.
9. Intellectual property
The Dibbbs name, logo, app design, and all related intellectual property are owned by Brewit Studio and protected under applicable Indian and international intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any Dibbbs property without our prior written consent. Nothing in these Terms grants you any licence to our intellectual property except the limited right to use the Platform in accordance with these Terms.
10. Third-party services
The Platform integrates with third-party services including Razorpay, Cashfree (payment processing), Supabase (database infrastructure), and others. Your use of those services is subject to their own terms and privacy policies. We are not responsible for the availability, security, or practices of these third parties, except to the extent required by applicable law.
The Platform may contain links to external websites. We do not endorse, control, or assume responsibility for any content on those websites.
11. Disclaimers
Platform availability. The Platform is provided "as is" and "as available." We do not warrant that the Platform will be uninterrupted, error-free, or free of harmful components. We may modify, suspend, or discontinue any feature at any time.
Food quality. Dibbbs does not inspect, verify, or guarantee the quality, safety, or freshness of food prepared by Chefs. We encourage users to review Chef profiles and ratings before ordering.
Marketplace only. We are a technology platform. We are not a party to any transaction between Customers and Chefs, except in our capacity as a payment facilitator.
12. Limitation of liability
To the maximum extent permitted by applicable Indian law, Dibbbs and Brewit Studio shall not be liable for:
- Indirect, incidental, consequential, or punitive damages
- Loss of profits, data, goodwill, or business opportunities
- Illness or injury resulting from food prepared by Chefs
- Delays or failures in delivery beyond our reasonable control
- Losses arising from third-party service outages (payment gateways, etc.)
Our total liability to you for any claim arising from your use of the Platform shall not exceed the amount you paid for the specific order giving rise to the claim, or ₹1,000, whichever is greater.
Nothing in these Terms excludes or limits liability that cannot be excluded under mandatory Indian consumer protection law, including the Consumer Protection Act, 2019.
13. Indemnification
You agree to indemnify and hold harmless Dibbbs, Brewit Studio, and their officers, employees, and agents from any claims, damages, costs, or expenses (including reasonable legal fees) arising from: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any applicable law; or (d) any User Content you submit. This includes claims by third parties, including other users and regulators.
14. Dispute resolution
We encourage you to contact us first at contact@dibbbs.app to resolve any issue informally. Most disputes can be resolved quickly through direct communication.
If informal resolution fails, any dispute, controversy, or claim arising out of or relating to these Terms, the Platform, or any transaction on it shall be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be Chennai, Tamil Nadu, India. The language of arbitration shall be English.
Notwithstanding the above, either party may seek urgent interim relief from a competent court. Consumer Protection Act remedies available to consumers under Indian law are not affected by this clause.
15. Governing law
These Terms are governed by and construed in accordance with the laws of India. Subject to the arbitration clause above, any disputes not referred to arbitration shall be subject to the exclusive jurisdiction of the courts in Chennai, Tamil Nadu, India.
16. Termination
By you. You may close your account at any time from the Profile section of the app. Pending orders will still be fulfilled or refunded per our standard policy.
By us. We reserve the right to suspend or terminate your account, with or without notice, if you violate these Terms, engage in fraudulent activity, or create legal or regulatory risk for Dibbbs. Upon termination, your right to use the Platform ends immediately. We may retain data as required by law or our Privacy Policy.
17. Changes to these Terms
We may update these Terms from time to time. When we do, we will update the "Last updated" date above. For material changes, we will notify you via in-app notification or email at least 7 days before the change takes effect. Your continued use of the Platform after changes take effect constitutes acceptance of the updated Terms. If you do not agree with the changes, you should stop using the Platform and close your account.
